Terms and Conditions of Business
For the Sale and Purchase of Commissioned Pet Portraits –
The prices for commissioned pet portraits displayed on this website are valid up to 31 st December 2015 but are subject to change at any time without prior warning. Delivery costs are included in the prices for UK Mainland destinations only. The shipping costs for destinations outside of UK Mainland will be calculated individually on request, based on size and type of commission. The purchaser will be responsible for any local import duties or regulations that may apply to deliveries outside of UK Mainland.
All quotes will be based on the information and instructions supplied by you, the purchaser, for each individual commissioned portrait. Once agreed and finalised, that portrait’s quote will be honoured for 30 days only. If you have not completed an order with a deposit payment for the commission within 30 days of the quote being given, contact me before ordering. Quotes that were agreed more than 30 days before ordering are not guaranteed as accurate and may be changed at my discretion. I will contact you before accepting your order/deposit if this is the case.
Deposits and Time Scales
Commission orders will only be accepted when accompanied by a non-refundable deposit of 30% of the agreed commission price. This then secures your place in my order of work and I will notify you of an approximate time-scale and expected completion date. Every effort will be made to meet this time-scale but it should not be taken as an absolute guarantee. I will advise of any unavoidable delays in completion of the commissioned work should they arise. I shall not be held liable for any inconvenience or loss incurred by the purchaser as a result of any delay in completion of paintings that may arise due to circumstances beyond my control.
I accept payments by Paypal, Bank Transfer, Gift Voucher, Gift Certificate or, for UK residents only, Cheque or Postal Order. Please see my Purchasing and Payment Options pages for instructions on how to use any of these methods to order your portrait. I require full payment for the completed portrait to be made within 10 working days of your final approval. I will retain all property rights until full payment has been received, at which point ownership then transfers to the purchaser.
7- Day Money Back Guarantee
It is guaranteed that if you wish to cancel the Commissioned Portrait, Gift Certificate or Gift Voucher and have notified me by email within 7 working days of placing your order, any payment you have made will be returned to you in full and the order cancelled.
Cancellation after 7 days
In the case of Gift Certificates and Gift Vouchers, all payments are non-refundable after 7 working days. If you wish to cancel a commission order at any point after the 7 day period, please notify me by email as soon as possible. Deposits will not be refunded after this point and if work has commenced on your portrait then there may be an additional charge calculated for the time already spent working on it. The portrait will remain the property of the artist.
An image of your completed portrait will be sent to you for approval prior to shipping. If at this point you wish to change any already-agreed characteristics, contact me straight away to discuss whether this is possible. Changes to final price and time-scales may apply in this case. Only when you are completely happy with your portrait and it has been approved by you will I ask for your full and final payment before shipping.
If on receipt of your portrait you are not fully satisfied then please contact me by email as soon as possible, stating the reason. If you do not wish to keep the portrait, it must be returned within 14 days of advising me, securely and in its original packaging with all shipping costs at your own expense. I will apply a cancellation charge of 70% of the total commission price and the remaining 30% will be refunded to you when I receive the rejected portrait. This will signify full cancellation of your order and I will retain full selling and reproduction rights for the work.
Comments and feedback given by you in emails or correspondence may be used, in part or full, on the PetPortraitArt website or promotional material for testimonial purposes.
If you would prefer your comments or feedback not to be used in this way please advise me at the time of ordering your commission.
Your privacy is of the utmost importance. The personal information you give me (such as email, address, telephone number) will only be used to contact you in relation to enquiries you have already made or an order you have already placed. They will not be used to advertise or publicise my business nor will I pass them on to any third parties. I will only use any telephone number(s) you choose to give me if a problem should arise with your order, or at your request.
As the artist I retain the copyright and all reproduction rights on the paintings and artwork I produce, including commissioned work, but I will not reproduce any completed commissioned work in any form of merchandise for profit, as I consider these to be personal to the final owner.
The purchaser, having no reproduction rights, must not reproduce or let anyone else reproduce the work without the Artist’s prior written consent.
Images of commissioned work may be displayed on this website or used by the artist in promotional material. If you would prefer this not to happen, please advise me at the time of ordering your commission.
All content and information on this website remains the copyright of ‘PetPortraitArt’ (the artist) including all images, artwork and text. Reproduction anywhere, in full or part, may result in legal action being taken unless prior permission has been given by me in writing.
Digital or printed photos that are sent or given to me for the painting of a portrait must be free and clear of all copyrights. The purchaser will be responsible for any legal action taken by others for use of material that is not free and clear of all copyrights. If your photo has been taken by a professional photographer, please make sure you have their permission to use it as reference for your portrait.
Gift Vouchers and Gift Certificates
Gift Vouchers and Gift Certificate Packs must be paid for in full when ordering and are non-refundable after 7 working days. They cannot be exchanged for cash. They are valid for 12 months from the date of purchase and will have the value and expiry date clearly indicated on them. Any amount that has not been redeemed before the expiry date cannot be refunded or credited. I reserve the right to view any voucher or certificate being redeemed for verification of authenticity. Damaged, defaced or altered vouchers and certificates cannot be replaced, refunded or redeemed.
These can be used in part or full payment (depending on value) toward any pet portrait commission as listed and priced on this website at the time of being redeemed. If the voucher’s value does not cover the 30% deposit necessary to secure the order, further payment will be required. I will advise you of this at the initial enquiry and/or quotation request stage. If the value of the gift voucher is less than the total cost but more than the 30% deposit required, your order can be secured immediately and the balance paid at completion.
Gift Certificate Packs
Values will only be indicated on the gift certificate in terms of the size and style of portrait chosen at the time of purchase. Each gift certificate can only be redeemed for a portrait of the same size and style as it’s face value, though the recipient will have the option to upgrade the size and/or style of their portrait, on the understanding that this will require the difference in price and shipping to be paid on completion.
